TERMS AND CONDITIONS OF THE FINNKINO WEB SERVICE

These terms and conditions (also “terms”) of Finnkino Ltd’s (“Finnkino”) web service (also “service”) apply to all customer transactions in the web service or Finnkino’s mobile app.

These terms apply to all customer transactions in the service regardless of what terminal device the customer uses the service on. The customer may only use the service in accordance with the prevailing terms and applicable law, as well as accepted practice. The service may also include sections or functions (such as the Finnkino online store) which, in addition to these terms, are subject to special terms or guidelines provided separately in the service, and may require registration to use. Some service content may only be available to customers in certain geographic areas.

The terms constitute an agreement between the customer and Finnkino, and define the rights and obligations of the customer and Finnkino as regards the service.

By using the service, the customer confirms that he/she has reviewed the prevailing terms and conditions and undertakes to comply with them, as well as the terms and guidelines provided separately in the service (such as the terms and conditions of the online store and the customer programme) in all use of the service.

2. On personal data

Finnkino handles personal data about the customer obtained through the service as permitted and required by prevailing personal data legislation. The handling of personal data is described in more detail in Finnkino’s register descriptions and privacy statement

3. Rights and restrictions regarding the use of the service

Finnkino grants the customer the limited, revocable, non-exclusive and personal right defined in these terms to use the service and its contents only in accordance with these terms and any terms and guidelines provided separately in the service. The customer has the right to use the service and its contents only for the customer’s personal, non-commercial use, and the customer does not have the right to transfer access to the service or his/her customer ID and/or password to a third party. 

The customer may not modify or reproduce the service or its contents, or a part thereof. Furthermore, the customer does not have the right to share, distribute, transmit, publicly display or otherwise render the service or its contents, as is or modified, available to the public unless explicitly authorised to do so under these terms. 

The customer may not interrupt or attempt to interrupt or otherwise interfere with or attempt to interfere with the operation of the service or the ability of other users to use the service in any way. Prohibited actions include, for example, adding into the service timed interference software, viruses or other material that could affect the programme structure of the service.

The customer may not use the service for actions contrary to these or other terms provided in the service, the law or accepted practice.  

4. Service provider duties and responsibility for the service

Finnkino strives to keep the service continuously available to the customer. However, Finnkino has the right to temporarily disable the service, or a part thereof, due to maintenance, hardware installation, public order and security, excessive load on the system or other necessary reasons. Furthermore, Finnkino cannot guarantee that the service is available to the customer in an uninterrupted, timely or faultless manner. Where possible, the aim is to communicate any changes or interruptions that are relevant to the customer in advance.

Finnkino also has the right to improve and change in any way it sees fit the content and structure of the service, product and database selection, software, hardware, contents of manuals and other documentation, service hours or other service components.

Finnkino strives to develop and maintain a high level of information security in its web service. Finnkino is only responsible for the contents of its own web service. Finnkino is not responsible for the contents of third-party services available through links on its website. Furthermore, Finnkino cannot guarantee the security or confidentiality of the contents of messages sent via the open data network.

The service may not be available in all countries and it may only be available in certain languages. The service, its functionality or some features may be dependent on the compatibility of the devices used, network connections and content formats.

The service and its contents are provided as is and the customer uses the service at his/her own risk. Finnkino is entitled to modify or change the service or its contents at any time without prior notice or liability for damages. Therefore, Finnkino has the right, for example, to change or modify the products and prices described in the service, add or remove parts of the service, as well as alter free parts of the service and subject them to a charge, or vice versa. Finnkino also has the right at any time to completely suspend or terminate the provision of the service, its contents or any part thereof, or to restrict the use of the service or its components.

Finnkino is not responsible for any damages or special damages that are direct, indirect or based on liability for damages. In all cases, Finnkino’s responsibility shall always, at most, be limited to its liability under imperative legislation. 

5. Customer responsibilities and obligations

Most services in Finnkino’s web service can be used by an unregistered customer. Tickets for films can be purchased without registration. In such cases, the tickets and purchase confirmation with receipt will be delivered to the e-mail address entered at the shopping cart stage. Ticket booking, voucher purchases and any other online store services require registration.

During registration, the customer selects a password and customer ID used to log in to the service and create a customer profile. The password and customer ID are personal and must not be disclosed to a third party. When registering as a customer of the service, the customer must provide accurate information about himself/herself as requested. Providing false information is prohibited and may result in sanctions.

The customer must ensure the careful storage and confidentiality of his/her customer ID and password. The customer is responsible for all use under this customer ID and password. If the customer discovers or suspects that his/her password or customer ID has been revealed or that they are being misused, the customer must immediately contact Finnkino. Finnkino has the right to suspend or close the customer’s credentials and customer profile.

The customer may also join Finnkino’s customer programme in the web service. This requires creating a customer account. Finnkino’s customer programme and joining the programme are subject to the terms of Finnkino’s customer programme.

If the customer has acted in a way that is contrary to these terms, terms or guidelines provided separately in the service or accepted practice, Finnkino has the right to prevent the customer from accessing the service and prohibit any future use of the service. 

The customer is liable for damages caused to Finnkino and/or third parties resulting from the customer’s actions that are contrary to the law, stipulations and guidelines from the authorities, or these terms. The customer discharges Finnkino and all its employees, managers and any parties acting on its behalf from liability for all such lawsuits and claims that result from the customer’s use of the service.

6. Links

The service may include links to websites that are owned and maintained by third parties. Finnkino does not monitor or review the contents of linked sites, and they are not in any way controlled by Finnkino. Finnkino is not responsible for the content, accuracy, reliability or information security of linked sites. 

When using links to external sites, the customer shifts away from the service and uses the linked sites at his/her own risk. The customer is advised to carefully review the terms, conditions and guidelines of the linked site before starting to use the site in question. 

An external link through which the customer can access this service must hyperlink directly to the main page of the service and open in a separate browser window, not the frame of the site providing the link. The appearance, placement or other properties of the link may not adversely affect Finnkino’s reputation or the goodwill of its trademarks, or create the false impression that the party providing the link or its services or products are associated with Finnkino’s operations or are sponsored by it. Furthermore, the link may not include Finnkino’s trademarks as designs.

Links to external sites in the service and any external links to the service do not indicate anything about the relationship between Finnkino and the third party linked or providing the link.

7. “Invite Your Friends” function

The mobile site of Finnkino’s web service includes an “Invite Your Friends” function. This function allows the customer to invite his/her contacts to watch a film by sending an invitation link to friends via e-mail, WhatsApp or Facebook by clicking on the “Invite Your Friends” link and selecting the icon of the desired messaging service from behind the link.

The contacts to whom the customer has sent the link can sign up for the films or showings suggested by the customer in the service, in which case the customer can see which film or showing the invited contacts select. A person who has received an invitation selects a pseudonym that is displayed in connection with the sign-up entry to everyone invited, as well as the sender of the invitation.

The customer can influence the content of the message by selecting a film or showing to which the customer wants to invite his/her friends. Finnkino does not identify customers who send invitation links or the contacts who sign up for films based on the invitations. Finnkino may use cookies to analyse the invitation and sign up analytics based on anonymous data.

The main purpose of sending an invitation link and its actual content is communication and exchange of opinions between users. Only the customer’s information is displayed in the sender information of the invitation link. Finnkino enables technical implementation of the invitation and signing up, as well as storing the sign up view in the web service. However, Finnkino does not influence the content of the message. 

8. Intellectual property rights

The service and its contents, such as text, images, product information, trademarks and logos, are the property of Finnkino or its partners and are protected by copyright laws and international copyright agreements, as well as other intellectual property laws and registrations.

All intellectual property rights related to the service and contents, such as copyrights, registered and unregistered trademark and design rights, domain names, patents, database rights and trade secrets, as well as the goodwill resulting from their use, belong to Finnkino or its partners. Finnkino does not grant any direct or indirect rights to any intellectual property rights to the customer.

9. Changes to the terms and notifications

Finnkino reserves the right to change these terms at its discretion by informing the customer of this via e-mail or through the service. The changes to the terms shall come into force with respect to the customer once they have been announced. Use of the service after the time of notification shall be considered as indicating that the customer accepts the changes made to the terms.

Finnkino may include notifications in the service. Finnkino may also send the customer notifications about the service to the e-mail address or telephone number specified by the customer. Notifications will be regarded as having been received seven (7) days after being sent or displayed by Finnkino. Continued use of the service means that the customer is considered to have received all notifications, regardless of the delivery method.

10. Applicable legislation and disputes

The use of the service and these terms are governed by Finnish law, with the exception of its connecting factor rules.

The parties shall seek to resolve disputes primarily through negotiation. If an amicable settlement is not reached, disputes will be settled in the Helsinki District Court in Finland. A consumer customer may also take a dispute to be resolved by a competent district court determined by his/her place of residence, or the Consumer Disputes Board.

TERMS AND CONDITIONS OF THE FINNKINO ONLINE STORE

 

1. General

These terms and conditions (also “terms”) of Finnkino Ltd’s (“Finnkino”) online store apply to all customer transactions in Finnkino’s web services or mobile apps. These terms apply to all customer transactions in the online store regardless of what terminal device the customer uses the service on. The customer may only use the online store in accordance with the prevailing terms and applicable law, as well as accepted practice. The terms constitute an agreement between the customer and Finnkino, and define the rights and obligations of the customer and Finnkino as regards the online store. 

When making bookings and purchases in the online store, the customer confirms that he/she has reviewed the prevailing terms and conditions and undertakes to comply with them.

In addition to these terms, the terms and conditions of Finnkino’s web service shall apply between the customer and Finnkino. Should there be any conflict between these terms and the terms of the web service, the terms of the web service shall prevail. If the customer has joined Finnkino’s customer programme, the terms of Finnkino’s customer programme shall prevail.

3. Registration

The customer may purchase tickets from Finnkino’s online store without registering as a customer of the online store. Registration to the online store is achieved by creating a customer profile where tickets can be stored.

When registering in the online store, the customer enters his/her e-mail address. This serves as the customer’s username in the online store. The customer must also select a password for the online store registration. The password is personal and disclosing it for the use of others is prohibited.

The customer can choose to join Finnkino’s customer programme; by joining it, the customer benefits from the discounts, benefits and promotional benefits offered by Finnkino.

Sending a sign-up e-mail and opening a customer account for the customer programme are required to join Finnkino’s customer programme. The customer account for the customer programme is opened by disclosing your e-mail address to Finnkino in accordance with the instructions available in Finnkino’s web service.

4. Booking tickets

Tickets for films that have been booked in the online store can be redeemed in the online store from the customer profile or via the cinema’s ticket sales outlets. The redemption period usually ends 45 minutes before the start of the film. However, the time of the film, opening hours of the cinema and advance sales of tickets, among other things, may affect the end of the redemption period. Tickets booked via advance sales should generally be redeemed within 4 days of the booking. The customer should always check the redemption period from the booking information.

If the booking quota for the film is full or the time to book tickets has expired, tickets can no longer be booked. Furthermore, it is not possible to book tickets for certain film festivals even if tickets are available for purchase in the online store.

5. Purchasing and redeeming tickets

E-vouchers, printable vouchers to be given as gifts, snack vouchers and tickets for films are available for purchase in Finnkino’s online store. Customers who have registered in the online store can also store tickets in their customer profile.

1–15 tickets can be purchased at a time. Vouchers and snack vouchers are sold in sets. Prices, size and validity vary. The affordable price of vouchers and snack vouchers is based on a quantity discount and limited time of use. Expired tickets cannot be exchanged or returned, and their validity period cannot be extended.

Vouchers can be used to redeem tickets from the online store, ticket machines or at ticket sales outlets. A voucher that is close to its expiry date can also be used to pay for films taking place after the validity period has expired as long as the tickets are redeemed before the expiry date.

Snack vouchers can be used at the cinema’s snack shop. It is not possible to purchase a new snack voucher from the online store with a snack voucher that is close to its expiry date.

All tickets for films shall be checked before entering the auditorium. The ticket to be checked can be a ticket printed at a ticket sales outlet or a machine, a self-printed ticket or a mobile ticket that is checked from the screen of a mobile phone. To prevent misuse, a picture taken of the above-mentioned tickets will not be valid for checking at the door of the auditorium.

6. Payment methods

The payment options valid in the online store include online banking credentials, the most common payment cards, Finnair Plus points, Finnkino’s paper vouchers, as well as electronic vouchers. The online banks available are Aktia, Danske Bank, Handelsbanken, Nordea, Osuuspankki, S-Bank and Ålandsbanken. The payment cards accepted in the online store are MasterCard, Visa and Visa Electron.

Online banking and payment card payments shall be made through the Netaxept payment service. Payments made in whole or in part with Finnair Plus points shall be made through Finnair’s payment service. Finnkino is not responsible for service disruptions due to telecommunication malfunctions or system disruptions of payment transaction partners. If there are any problems with a payment transaction or ticket delivery, please complete the web store error report form. If the error occurs when paying with Finnair Plus points, please contact Finnair’s customer service directly at finnair.plus@finnair.fi.

7. Cancellations

A ticket booking may be cancelled during the redemption period by logging in to the online store customer profile. In principle, the customer is not entitled to cancel purchased tickets because the purchase is for a recreational service taking place at a specific time.

In the event of an obstacle, tickets that have already been redeemed may be exchanged at a ticket sales outlet of any Finnkino cinema no later than one hour before the start of the film. Purchased tickets may also be cancelled against a handling fee of EUR 8.00 by completing the cancellation form on the online store or by calling Kinolippu (0600 007 007, EUR 1.99/min + local network charge/mobile call charge).

8. Discounts and benefits

The discounts and benefits granted to the customer are determined based on the information entered in the customer account in accordance with the terms of the customer programme.

9. Wheelchair spaces

All Finnkino auditoriums have a limited number of wheelchair spaces. It is advisable to book or purchase tickets for the wheelchair spaces in advance due to the limited number of spaces and possible need to make special arrangements, etc. Bookings can be made by phone, from the cinema’s ticket counter or the online store, from which the tickets can also be purchased.

A free ticket for a helper can be booked in addition to the ticket for a wheelchair space by using the ticket category “Normal”. When the booked tickets are redeemed at the ticket counter, the salesperson will change the helper’s ticket to a free ticket. It is not possible to obtain a free ticket in the online store.

10. Fault situations

Fault situations in the online store most commonly result from the ticket sales system not receiving a confirmation of a payment made via online banking. Typical reasons for a failed ticket delivery include exceeding the period reserved for payment (15 minutes), as well as disconnection before the browser returns to Finnkino’s web service.

Online banking and payment card payments shall be made through the Netaxept payment service. Payments made in whole or in part with Finnair Plus points shall be made through Finnair’s payment service. Finnkino is not responsible for service disruptions due to telecommunication malfunctions or the system disruptions of its payment transaction partners. If there are any problems with a payment transaction or ticket delivery, the customer should complete the online store error report form. If the error occurs when paying with Finnair Plus points, the customer should contact Finnair’s customer service directly at finnair.plus@finnair.fi.

If a purchase confirmation page does not open after payment has been made or an error message is displayed after payment, it is advisable to check whether the purchase was successful from the customer profile. The details of a successful ticket purchase will be displayed under Ticket purchases in the customer profile. When purchasing printable vouchers or snack vouchers, the tickets will also be sent via e-mail as PDF attachments. If a paid purchase does not appear in the customer profile and no purchase confirmation e-mail is received, it is likely that the purchase has been cancelled. In such cases, the customer should make the purchase again and request a refund for the original charge as follows:

  • The customer completes the online purchase error report form. The form information is sent for processing by Finnkino’s customer service.
  • The customer purchases the tickets again.
  • The refund will be paid about one week after the refund request has been received.

Credit card payments will be credited directly to the credit card.

11. Mistaken purchase

If an error has been made in selecting the film and tickets have been purchased for the wrong film, the tickets may be exchanged free of charge at a ticket sales outlet of any Finnkino cinema before the start of the film for which the tickets were purchased in error. Tickets cannot be exchanged afterwards and Finnkino does not offer refunds for unused tickets.

E-vouchers purchased in error cannot be exchanged for printable vouchers or vice versa.

TERMS OF FINNKINO’S CUSTOMER PROGRAMME 
 

1. General

These terms apply to the customer programme of Finnkino Ltd (hereinafter referred to as “Finnkino”). An agreement is made between the customer and Finnkino once the customer has accepted these terms and joins the customer programme as described in section 2. The membership of the customer programme is valid until further notice unless it is terminated in accordance with these terms.

By joining Finnkino’s customer programme, the customer accepts these terms and will be notified about the handling of personal and location data associated with the customer relationship, as well as the benefits, features, content and communications it includes.

In addition to these terms, the terms and conditions of Finnkino’s web service  and the terms and conditions of Finnkino’s online store shall apply between the customer and Finnkino. Finnkino encourages customers to review the terms carefully. Should there be any conflict between these terms and the other terms, these terms shall prevail as regards the customer programme.

Finnkino has the right to decide what service channels it provides.  

2. Joining and customer details

Any individual (consumer) over 15 years of age with a valid e-mail address may join the customer programme. It is possible to join the customer programme on Finnkino’s website. Joining the customer programme requires creating a customer account.

Finnkino reserves the right to accept or decline entry.

The customer must provide accurate and up-to-date information to all questions asked in connection with joining. If the customer’s details subsequently change, the customer must inform Finnkino about the changed details without delay. Finnkino will correct and update the information based on the notification. Providing false information is prohibited and may result in sanctions.

The customer programme is free but it may include sections or services subject to a charge.

3. Customer account

The customer account for the customer programme is opened by disclosing your e-mail address to Finnkino in accordance with the instructions available in Finnkino’s web service.

Upon joining the customer programme, the customer enters his/her e-mail address to which the customer will be sent an a-mail about the customer programme. The customer can view and handle his/her personal customer account by clicking the “View details” link in the e-mail about the customer programme. 

Information about the right to the benefits and discounts described under section 4 of these terms shall be added to the customer’s account.

If the customer suspects or knows that his/her e-mail credentials have been disclosed to a third party or that the customer account is otherwise being misused, the customer must immediately report this to Finnkino. In such cases, Finnkino has the right to close the customer’s account either temporarily or permanently. Finnkino also has the right to close the customer’s account if Finnkino has reasonable grounds to suspect that the customer’s account has come into the possession of a third party or is otherwise being misused.

4. Benefits and discounts

The customer can purchase film tickets either from a Finnkino office, Finnkino’s online store or through Finnkino’s mobile app. The customer will receive discounts in accordance with his/her customer type, as well as the general benefits and discounts of the customer programme to his/her customer account. The customer will be granted the right to benefits and discounts based on the personalised codes delivered to the customer account in Finnkino’s online store or at Finnkino offices.

Pensioners and conscripts, as well as persons undergoing non-military service, have the opportunity to purchase film tickets at a discounted rate.  The customer will receive a 30% discount from the normal ticket price for films starting before 17.00 and a 20% discount from the normal ticket price at other times. The discount also applies to 3D films and is valid every day of the week.

Secondary and tertiary students will receive a 30% discount from the normal ticket price on weekdays for films starting before 17.00 and a 20% discount on weekdays for films starting after 17.00, as well as a 10% discount from normal Event Cinema ticket prices for weekday films. Finnkino also offers students monthly promotional benefits.  

Discounts and benefits are personal and shall be valid as long as there are valid grounds for receiving benefits. Upon request, the customer must be prepared to present a certificate verifying his/her customer type, such as a student card or a certificate of military or non-military service, at Finnkino’s office in connection with the ticket check. A pensioner, conscript or student discount or the discount granted to persons undergoing non-military service cannot be combined with promotions, special prices or vouchers.

Finnkino also offers other promotion-like benefits and discounts through the customer programme. Finnkino may also provide events and services, as well as benefits or other content provided by Finnkino’s partners, to individuals who have joined the customer programme.

5. Customer communications and direct marketing in the customer programme

Finnkino may send customer communications and direct marketing material to individuals who have joined the customer programme. The communications and marketing material  related to the customer programme is usually submitted via e-mail. Communications and marketing material may also be sent via the mobile app, web service or text messages.

By accepting these terms, you accept the submission of electronic customer communications and direct marketing material via e-mail, as well as other electronic means.

For example, Finnkino may send customers newsletters and information about Finnkino’s operations, upcoming premieres and promotions. Finnkino may also send customers information about discounts and benefits.

Because customer communications and direct marketing are an essential and integral part of the customer programme, the customer may only prohibit electronic customer communications by terminating this customer programme in accordance with section 7 of the agreement.

6. Handling of personal data

Finnkino handles the personal data of customers who have joined the customer programme as permitted and required by prevailing personal data legislation. Personal data is handled as described in the register description for Finnkino’s customer programme. The data accumulated from the customer programme is used to manage and develop the customer relationship, to analyse Finnkino’s operations and to develop and target the benefits and discounts offered to individuals who have joined the customer programme.

Finnkino may handle location data to provide location-based services and to present targeted offers, provided that the customer has consented to the use of location data.

Finnkino strives to protect the personal data it handles from unauthorised access and unlawful handling through the reasonable means at its disposal, such as firewalls and other technical means.

7. Changing the terms and termination of the customer programme

Finnkino reserves the right to change the content and terms of the customer programme, as well as the right to terminate the customer programme. Finnkino aims to announce significant changes well in advance, at least two (2) weeks before the changes enter into force. The notification shall be deemed to have been duly given when it is available to read in Finnkino’s online store or mobile app, or has been sent to the e-mail address provided by the customer.

The customer may terminate the customer programme membership by notifying Finnkino’s customer service at asiakaspalvelu@finnkino.fi.   Finnkino, in turn, may terminate the customer programme membership with a one (1) month period of notice. If the customer misuses services related to the customer programme or otherwise violates these terms or any special terms regarding certain benefits or content, Finnkino has the right to terminate the customer relationship immediately without prior notice.
